1. Agreement to Terms

By creating an account, connecting your Instagram professional account, accessing our dashboard, or subscribing to any paid plan on KRYSKAFLOW, you agree to be bound by these Terms of Service, our Privacy Policy, and our canonical Legal & Compliance Center. If you do not agree to these terms, you must not access or use our services.

2. Eligibility & Statutory Age Requirements (COPPA & Contract Capacity)

In strict compliance with the United States Children's Online Privacy Protection Act (COPPA, 15 U.S.C. §§ 6501–6506), Section 9 of the India DPDP Act 2023, and Section 11 of the Indian Contract Act, 1872:

• Platform Access (13+ Years): You must be at least thirteen (13) years of age to access or browse the service. Account creation for individuals under 13 is strictly prohibited and automatically blocked.
• Contractual Capacity for Paid Subscriptions (18+ Years): To subscribe to any paid recurring tier, activate payment mandates, or enter legally binding financial commitments, you must have attained the age of majority (eighteen (18) years of age) or possess verified legal parental/guardian authorization.
• Account Security: You are solely responsible for safeguarding your login credentials and for all activities, keyword configurations, and messages transmitted under your account.

3. Acceptable Use Policy & Anti-Spam Compliance

KRYSKAFLOW provides neutral technical infrastructure for legitimate creator audience engagement. You strictly agree NOT to:

• Configure automation triggers to transmit deceptive phishing links, malware, illegal contraband, unauthorized multi-level marketing schemes, or fraudulent promotions.
• Send unsolicited commercial bulk outreach or abusive messaging in violation of the US CAN-SPAM Act, Canadian CASL, or Meta's Platform Terms and Community Guidelines.
• Attempt to reverse-engineer, decompile, scrape, or circumvent KRYSKAFLOW's security controls, rate-limiting algorithms, or fair usage caps.
• Violate intellectual property rights, trademarks, or trade secrets of third parties in your automated messages or link destinations.

4. Subscription Billing, Multi-Currency & Non-Refundable Policy

• Multi-Currency Billing: Subscriptions are billed in Indian Rupees (INR) for domestic accounts via UPI AutoPay, NetBanking, or Cards, and in US Dollars (USD) for international accounts via Stripe, PayPal, or Cards.
• All Sales Final & Strictly Non-Refundable: Because cloud computing capacity, Meta Graph API rate-limit allocations, and webhook listeners are provisioned immediately upon purchase, all subscription fees, booster passes, and renewals are final and strictly non-refundable once account activation occurs. We do not provide refunds or credits for partially used billing cycles, unused DM quotas, or change of mind.
• 1-Click Self-Serve Cancellation: You may cancel recurring auto-renewals at any time via Dashboard > Plan & Billing or by revoking UPI AutoPay mandates inside your UPI app (GPay/PhonePe/Paytm). Paid benefits remain active until the billing cycle expires; no subsequent renewals will be charged.
• Technical Discrepancies (RBI Compliant): Verified technical duplicate charges are reversed within 5–7 business days to the original payment method pursuant to RBI payment directives.

5. Third-Party Platform Safe Harbor (Meta & Instagram Independence)

• Independent Software Provider: KRYSKAFLOW is an independent software tool interacting with Meta's official public Graph API. KRYSKAFLOW is not affiliated with, sponsored, or certified by Meta Platforms, Inc. or Instagram.
• Zero Liability for Platform Actions: Kryska and founder Ankush Kumar Rajwar exercise zero control over Instagram's internal algorithms, feed distribution changes, spam filters, action blocks, or account suspensions. The Creator assumes 100% independent risk for their Instagram account compliance and social media standing.

6. Express Disclaimer of Warranties ("AS IS" & "AS AVAILABLE")

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• NO WARRANTIES: THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. KRYSKA, KRYSKAFLOW, AND FOUNDER ANKUSH KUMAR RAJWAR EXPRESSLY DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, AND NON-INFRINGEMENT.
• NO GUARANTEE OF UPTIME OR RESULTS: WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, TIMELY, OR ERROR-FREE, OR THAT AUTOMATION SEQUENCES WILL RESULT IN ANY SPECIFIC LEVEL OF INCREASED FOLLOWERS, SALES, OR MONETARY RETURN.

7. Limitation of Liability & Strict Financial Cap

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• Waiver of Consequential Damages: IN NO EVENT SHALL KRYSKA, KRYSKAFLOW, OR FOUNDER ANKUSH KUMAR RAJWAR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF SALES, LOSS OF REPUTATION, ACCOUNT RESTRICTIONS, OR BUSINESS INTERRUPTION, REGARDLESS OF THE CAUSE OF ACTION.
• Strict Financial Liability Cap: UNDER NO CIRCUMSTANCES SHALL THE TOTAL CUMULATIVE LIABILITY OF KRYSKA, KRYSKAFLOW, OR FOUNDER ANKUSH KUMAR RAJWAR ARISING OUT OF OR RELATING TO THESE TERMS OR THE USE OF THE SERVICE EXCEED THE LESSER OF:
  (A) THE TOTAL SUBSCRIPTION FEE ACTUALLY PAID BY YOU TO KRYSKAFLOW IN THE IMMEDIATELY PRECEDING ONE (1) MONTH BILLING PERIOD, OR
  (B) FIVE HUNDRED INDIAN RUPEES (INR ₹500.00).

8. User Indemnification

You agree to defend, indemnify, and hold harmless Kryska, KRYSKAFLOW, and founder Ankush Kumar Rajwar from and against any and all claims, liabilities, damages, losses, costs, expenses, regulatory fines, or reasonable legal and attorney fees arising out of or related to:

• Your configuration of keywords, direct message content, promotional offers, or external link destinations.
• Any violation by you of Meta's Platform Terms, Community Guidelines, or applicable anti-spam, copyright, or data privacy laws worldwide.
• Any claim by an end-user or commenter resulting from messages dispatched through your account.

9. Governing Law, Exclusive Venue & Class Action Waiver

• Governing Law: These Terms and any dispute arising out of or related to them shall be governed exclusively by the laws of the Republic of India, without regard to conflict of law principles.
• Exclusive Local Jurisdiction: The parties agree that the Competent Courts situated in Bokaro Steel City, Jharkhand, India shall have exclusive territorial and subject-matter jurisdiction over any dispute, lawsuit, or judicial proceeding arising under these Terms.
• Mutual Class Action Waiver: ALL DISPUTES MUST BE RESOLVED ON AN INDIVIDUAL BASIS. YOU EXPRESSLY WAIVE ANY RIGHT TO COMMENCE, JOIN, OR PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, MASS, COLLECTIVE, OR REPRESENTATIVE ACTION AGAINST KRYSKA OR ANKUSH KUMAR RAJWAR.
